Landlord’s Electrical Certificates Burford
According to the office for National Statistics, the number of households living in the private rental sector in the UK increased from 2.8 million in 2007 to 4.5 million in 2017. A huge increase of 1.7 million (63%).
With demand growing in the Burford area and more properties coming on to the rental market, it is vital that each Landlords knows their responsibilities / duty of care to their tenants, including providing Electrical Safety Certificates. The Landlord and Tenant Act 1985 is the main legislation for landlords in England and Wales.
The Landlords and Tenants Act 1985 requires that the electrical installation in a property is safe when a tenancy starts. This also includes to keep the property in a safe condition throughout the tenancy. The Act makes it an implied term of every tenancy that the landlord will ‘keep in repair the structure and exterior’ of the property and ‘keep in repair and proper working order the installations in the dwelling-house for the supply of water, gas and electricity’.
As detailed from the Electrical Safety Organisation, Landlords have a requirement by law to ensure:
- The electrical installation in a rental is safe when tenants move in and maintained in this condition throughout its duration.
- That a House in Multiple Occupation (HMO) has an EICR (periodic inspection) carried out on the property every five years. If the property is not an HMO, you are not legally obliged to do this. However, we recommend that an EICR (periodic inspection and test) is carried out by a registered electrician on your rental properties at least every five years.
- That any appliance provided is safe and has at least the CE marking (which is the manufacturer’s claim that it meets all the requirements of European law).
Landlord Electrical Testing & Inspections –
Our Burford Electricians who carry out electrical testing are qualified to the 18th Edition IET (City & Guilds 2382-18) wiring regulations and CITY & GUILDS Inspection & Testing Certification of Electrical Installations. This allows each electrician to complete and sign off their own work as well as inspect and test work completed by 3rd party electricians. The Electrical Installation –
The electrical installation consists of all the fixed equipment that is supplied through the electricity meter. It includes the cables – generally hidden behind the walls and ceilings, sockets, switches, lights and the Fuse board (Consumer Unit) that contains all the fuses, circuit-breakers and RCD’s (residual current devices).
What is an EICR (Electrical Installation Condition Report)?
An EICR is a full report which details the condition of the electrical installation. It details all of the testing results and advises whether the electrical wiring meets the current 18th Edition IET regulations. If the electrics do not meet the regulations the report will advise of the electrical issues. Giving graded remedial works required as detailed below:
C1: Danger present. Risk of injury. Immediate remedial action needed.
C2: Could be dangerous – Urgent remedial action needed.
C3: Improvement advised.
FI: Further investigation needed without delay.
PAT Testing –
Passed PAT tested appliances that have passed a PAT test are deemed to be safe to use until the next test date. The next test date in most circumstances will be 12 months from the date of a passed test. However, this can change in certain circumstances. For Landlords, items should be tested prior to a new tenant – even if this is less than 12 months from the previous test date.
Visual Checks –
There are some simple visual checks that Tenants can do to be able to keep the Landlord up to date. This includes the general safety of the electrical installation.
Things to look out for and report to the Landlord are:
- Broken sockets and light switches.
- Signs of scorching around sockets due to overloading.
- Overheating of electrical items (i.e. light fittings fitted with the wrong lamps) – normally noticed by a strong, often fish-like, smell.
- Damaged cables to portable electrical appliances or trailing cables / flexes.
